SMS/TEXT MESSAGING TERMS (Toll‑Free Program) These SMS Terms govern your participation in our text messaging programs, which may include non‑marketing (“Informational”) and marketing (“Promotional”) messages.

A) Opt‑In and Consent

• You must expressly opt in to receive SMS messages by selecting the appropriate, non‑pre‑checked checkbox on our web forms or by otherwise providing written consent. Consent is not required to use the non‑SMS portions of the Services.
• Separate consent is required for Promotional messages. Informational messages (e.g., account alerts, appointment reminders) require their own consent. These consents are separate from acceptance of the Site’s Terms and Privacy Policy.

• We maintain records of your consent (e.g., timestamp, form source).
• We do not sell or share your SMS opt‑in consent or phone number with third parties for their own marketing.
• We may share data with service providers solely to deliver messages (e.g., messaging platforms, carriers) under agreements that restrict their use of your data.

G) Device and Number Ownership

• By opting in, you represent you are the account holder or have the account holder’s permission for the phone number provided. Notify us if you change or relinquish your number.

• Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier.

I) 2FA/Single‑Message Programs

• For single‑use messages such as verification codes, you may receive a one‑time message per request. HELP/STOP disclosures may not apply to single‑message programs.

J) Changes to SMS Program

• We may modify or discontinue the SMS program or these SMS Terms at any time. We will notify you of material changes as required.

Disclaimers; Limitation of Liability

• THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
• TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
• OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE EVENT, WHICHEVER IS GREATER. Because no purchases occur via the Site, this cap will generally be $100.

Indemnification

• You agree to indemnify and hold us harmless from claims arising out of your misuse of the Services, your violation of these Terms, or your infringement of any rights of another.

Changes to These Terms

• We may update these Terms from time to time. The “Effective Date” will be updated when changes are posted. Your continued use constitutes acceptance of the updated Terms.

Governing Law; Dispute Resolution

• These Terms are governed by the laws of the State of Nevada, without regard to conflicts of law.
• Venue for disputes shall be the state or federal courts located in Clark County, Nevada.
